END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Dynomatik Limited ("Dynomatik", "we", "us", or "our") governing your use of the RacePro mobile application ("App"). By downloading, installing, accessing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not use the App.

License Grant

Subject to your compliance with the terms of this Agreement, Dynomatik grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal and non-commercial purposes.

2. Restrictions

You shall not, directly or indirectly:

i. Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App;
ii. Rent, lease, lend, sell, sublicense, distribute, transfer, or otherwise make the App available to any third party;
iii. Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices contained in the App;
iv. Use the App for any illegal, harmful, or unauthorised purpose;
v. Interfere with, disrupt, or attempt to gain unauthorised access to the servers, networks, or systems connected to the App;
vi. Use the App in a manner that could damage, disable, overburden, or impair the functionality or performance of the App;
vii. Use any automated means or interface not provided by Dynomatik to access the App or extract data from the App.

3. Privacy Policy

Your use of the App is subject to Dynomatik's Privacy Policy, which is incorporated by reference into this Agreement. By using the App, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

4. Ownership

The App, including all intellectual property rights therein, is and shall remain the exclusive property of Dynomatik and its licensors. Except for the limited license granted to you under this Agreement, Dynomatik reserves all rights not expressly granted to you.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DYNOMATIK DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

IN NO EVENT SHALL DYNOMATIK OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER OR NOT DYNOMATIK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Termination

This Agreement is effective until terminated by you or Dynomatik. Dynomatik may terminate this Agreement at any time without notice if you fail to comply with any term of this Agreement. Upon termination, you shall cease all use of the App and delete all copies of the App from your mobile device.

8. Miscellaneous

This Agreement constitutes the entire agreement between you and Dynomatik concerning the subject matter hereof, and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether oral or written.

b. This Agreement shall be governed by and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law provisions.

c. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

d. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permitted by law.

e. Dynomatik's failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.

f. This Agreement may be amended or modified only by a written instrument executed by both parties.

By clicking "I agree" or by downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.
